TERMS OF SERVICES

Article 1: Migii.net Account Registration Principles

1. Account Registration Responsibility:
You are solely responsible for all information provided during Migii.net account registration, as well as any subsequent modifications or additions to your account details.

2. Adherence to Agreements and Regulations:
In addition to complying with these Terms of Service, you must strictly adhere to all other agreements, regulations, and procedures of Migii.net that are publicly posted on the Migii.net website.

3. Restrictions on Username Selection:
You are prohibited from creating usernames that utilize the names of famous individuals, government officials, criminal organizations, or individuals involved in criminal activities. Additionally, usernames should not be offensive, indecent, or violate common decency.

Article 2: Service Registration and Termination

1. User Agreement
By registering for an account, you confirm that you have read, understood, and agreed to all the provisions of Migii.net's Terms of Service.

2. Information Accuracy and Updates
Upon registering, you agree to provide truthful and complete information and to update this information as any changes occur in reality. For details on information collection, usage, and protection, please refer to our Privacy Policy.

3. Account Creation and Security
During registration, you will create a Migii.net account with a username and password. You agree to take full responsibility for protecting your username and password to prevent unauthorized use by others. You must promptly notify Migii.net of any unauthorized use. Account creation on mobile devices may require data transmission, and you will be responsible for any associated data charges.

4. Account Termination
You may terminate your registration if you no longer wish to use Migii.net's services. Migii.net may terminate your registration or restrict your access to certain parts of the service if there is reasonable grounds to determine that you have violated the Terms

Article 3: Prohibited Content for Sharing on Social Media

1. Subversion of state, incitement of violence, and dissemination of misinformation: It is strictly prohibited to propagate, sabotage, or distort information regarding the government, political structure, and national policies. Incitement of violence, promotion of war, spreading hatred, and encouraging deviant behavior, crimes are prohibited. Dissemination of superstitious beliefs, misconceptions, or disruption of cultural traditions is not allowed. Posting articles from foreign sources such as BBC Vietnamese, VOA Vietnamese... is prohibited. Calls for organizing riots and posting information about protests, riots are forbidden.
2. Damage to the reputation of products, gambling organizations: Any behavior that damages the reputation of the company's products is absolutely unacceptable. Organizing any form of gambling, betting, or related agreements involving money, valuables, or assets is strictly prohibited.
3. Insulting, mocking others, disrupting communities: Insulting, mocking others in any form is strictly prohibited. Actions that disrupt and affect the values of the community are prohibited.
4. Content inappropriate to Vietnamese customs and laws: It is strictly forbidden to discuss topics unrelated to the Communist Party of Vietnam, the Vietnamese state, political institutions, history, and leaders. Any act of impersonation or intentional misrepresentation to deceive is prohibited.
5. Content inappropriate to ethical standards: Sending or transmitting illegal, deceptive, defamatory, obscene, vulgar, pornographic, offensive, threatening, abusive, hateful, provocative, or contrary to the general ethical standards of society is prohibited. Detailed descriptions of obscene, violent, or homicidal acts; posting of repulsive images, lacking humanity, or providing provocative content, inappropriate to Vietnamese customs, are prohibited.
6. Advertising propaganda: Advertising any message, invitation, chain letter, or investment opportunity not desired by users is strictly prohibited.
7.Content management: We reserve the right to edit or remove any posts that violate the above regulations, and any violations will be dealt with accordingly.
8. Protection of ownership and privacy rights: Do not send or transmit any information or software that is not owned by you. Prohibition of using information that violates intellectual property regulations or other provisions of current law.
9. Do not invade the system: Unauthorized intrusion, access, use, or attempted intrusion into our system is strictly prohibited. Exploiting system vulnerabilities for personal gain and creating counterfeit information are prohibited.
10. Login restrictions: Each premium account is allowed to log in to a maximum of 3 devices at the same time.
11. From 01/07/2021, all posts aimed at advertising to lure users to switch to another app/web without consent from EUP TECHNOLOGY.,JSC. will be deleted. In case of repeated violations: Account suspension for 1 month or permanent suspension depending on the severity of the violation.

Article 4: Mechanisms for Handling Members Violating the Agreement

1. Processing Principles
- If a User violates the terms stipulated in the Agreement for the provision and use of social media services or in any way poses risks or legal liabilities to EUP TECHNOLOGY.,JSC, the User will be warned, cautioned, and appropriate measures will be taken, including handling posts, temporary or permanent account suspension.
- The penalty of temporarily or permanently locking the Migii.net account implies that the User cannot access other products using the locked account. In severe violation cases, Migii may block the IP address without prior notice.
- If the Migii.net account is permanently locked, all the rights of the Account Owner will also be permanently locked.
- The prohibited behaviors of the User are not listed below; depending on specific cases, the Migii.net Administration Deparment has full authority to impose appropriate penalties according to the provisions of this agreement.
- All posts violating the regulations may be deleted, transferred to another category, advertisements removed, inappropriate language replaced, temporarily suspended from display pending review depending on the severity of the violation. Migii.net may send warning notices for violating content and require Users to immediately remove or filter out the violating content. If the User does not remove or filter out the violating content, the Migii.net Administration Department will handle the post and suspend the User's account.
- The Administration Department has full authority in identifying and handling posts/members violating the regulations. Processing logs will be stored for a minimum of two years, and the Administration has the full right to publicly disclose violations by Members, excluding deleted or filtered-out violating content.

2. Forms of Penalties:
2.1. Special-level penalties, permanent lockouts are applied, including but not limited to the following behaviors:
* Users engaging in activities exploiting Migii.net to subvert the Socialist Republic of Vietnam. This includes but is not limited to Users using account names/member names identical to national heroes, national leaders of the Party and State, or users utilizing images, videos, speeches... containing discussions on political issues or revealing state secrets of the Socialist Republic of Vietnam.
* Pornographic information, images, videos: Users posting pornographic images, sounds, videos, engaging in sex chats, or promoting pornographic content.
* Gambling information: Exploiting Migii.net, users post content such as information, images, sounds, videos containing information to organize gambling activities, or agreements related to money, gold, goods.
* Spreading fraudulent information: Using text, images, sounds, or videos containing fraudulent information: impersonating official entities or individuals; defrauding, deceiving others' property or Migii.net accounts, accumulation points.

2.2. Level 1 penalties: 10-day account suspension is applied, including but not limited to the following behaviors:
* Communication behaviors: Mild sexual harassment, spamming messages, inciting other members to disturb discussion groups or disseminate violating information.
* Advertising: Member names, statuses, self-explanations containing advertising information or using text, images, sounds, or videos and advertising information without written consent from EUP TECHNOLOGY.,JSC. Additionally, members using products for advertising, propaganda, trading, and promoting prohibited goods or services; in this case, depending on the severity, either level 2 or level 3 penalties may apply.
* Privacy infringement: Using others' personal images, publicly sharing personal documents and others' information such as identity, address, phone number without consent and making harassing phone calls or inciting others to harass.
* Attacking others: Using images, information, sounds, or videos to insult, disseminate misinformation, fabricate, ridicule, or discredit organizations, individuals.
* Copyright infringement: Stealing content, copying or quoting without permission the copyrighted work of others.

2.3. Level 3 penalties: 120-day account suspension is applied, including but not limited to the following behaviors:
* Disrupting the Migii.net social media system: Users exploit product usage to infiltrate server systems to disrupt products or interfere with information access. Users use technical tools to increase activity points, items, or to hang, spam chat.
* Using Discussion Forums or Group Activities to lure real-life meetings outside to engage in illegal activities

Rights and Responsibilities of the Parties

Article 5: Rights of Migii.net Social Network Users

1. Right to Use Migii.net Social Network Services
Users have the right to use all Migii.net social network services except those prohibited by law.

2. Right to Modify and Supplement Account Information
Users have the right to modify and supplement their account information, including password, identification documents, and registered email address.

3. Right to Receive Instructions on Password Security
Users have the right to receive instructions on how to set a secure password, enter important information to protect their account, and use linked accounts to log in to their account.

4. Right to Gift Migii.net Accounts
Users have the right to gift their Migii.net accounts to others. The right to gift an account only applies to accounts that have been fully registered and provide accurate account information in accordance with the Migii.net Terms of Use.

5. Right to Privacy Protection
Users have the right to have their private information and personal information protected in accordance with the law.

Article 6: Responsibilities of Social Network Users

1. Account Registration and Information Accuracy
To receive support from Migii.net, users' account must be fully registered with complete and accurate information. If there are any changes or additions to user's information, please update Migii Customer Service Center immediately. You guarantee that your current information is the latest, complete, truthful, and accurate, and you are responsible for all the information you provide.

2. Account Security
Users are responsible for the security of your account information, including password, identification documents, account protection email, and linked accounts. If this information is disclosed in any form, users must accept the risks that may arise. Migii.net will base on the information available in the account to determine account ownership in case of disputes and will not be responsible for any losses arising. Identity document information registered in the account is the most important information to prove account ownership.

3. Reporting Unauthorized Use and Security Breaches
Users agree to immediately notify Migii.net of any unauthorized use of user's account and password or any security breaches. Users also ensure that they always log out of your account after each use.

4. Compliance with Social Network Management, Provision and Usage Agreement
Users agree to comply with the social network management, provision, and usage agreement.

5. Responsibility for Content
Users are responsible for the content of the information you store, provide, or transmit on the social network, and for the dissemination of information through direct links that you establish.

6. Reporting Errors and Issues
If users discover any errors or problems that affect the normal operation of Migii.net, please notify Migii Customer Service by phone at 0865 924 188.

7. Legal Use of Digital Content
Users agree to take responsibility for ensuring the legal use of digital content uploaded on the Internet and telecommunications networks.

8. Compliance with Prohibited Acts
Users must strictly comply with the provisions of Article 2 of this agreement regarding prohibited acts. If users violate one or more of these acts, depending on the severity of the violation, Migii.net will permanently block their account and revoke all their rights.

9. Compliance with Information Security Regulations
Users must comply with the regulations on information security, network security, and other related regulations in Decree 72/2013/NĐ-CP on the management, provision, and use of internet services and information on the network.

10. Other Legal Responsibilities
Users must fulfill other responsibilities as prescribed by law.

Article 7: Rights of EUP TECHNOLOGY.,JSC.

1. Termination of User Accounts
If users provides any information that is untrue or inaccurate, or if EUP TECHNOLOGY.,JSC. has reason to suspect that such information is inaccurate, or if users violates any provision of this Terms or any other Migii.net Terms of Use or terms of use for other products and services as specified on the website, EUP TECHNOLOGY.,JSC. has the right to terminate and delete users's account without users's consent and without any liability to users.

2. Enforcement of Terms of Use
For any violation of the Terms of Use by the Account Owner in the course of using the Migii.net product, EUP TECHNOLOGY.,JSC. has the right to apply sanctions in accordance with the provisions of this Agreement, such as removing or deleting infringing content, revoking all rights of the Account Owner to use the product, and requesting the competent authorities to prosecute the Account Owner before the law if necessary.

3. Cooperation with Law Enforcement
Upon discovering violations such as fraud, sabotage, distribution of prohibited content, or any violation of legal regulations through the use of Migii.net, EUP TECHNOLOGY.,JSC. has the right to use the personal information provided by users when registering an account to transfer to the competent authorities for settlement in accordance with the law.

4. Refusal of Support
EUP TECHNOLOGY.,JSC. has the right to refuse support and resolution for Accounts that are registered with inaccurate or incomplete information in accordance with the regulations and for Accounts that violate the account security responsibilities specified in this Agreement.

5. Modification of Terms of Use
EUP TECHNOLOGY.,JSC. has the right to apply additional terms of service without the need for users's consent.

6. Commercialization of Services
EUP TECHNOLOGY.,JSC. has the right to commercialize the Migii.net service, however EUP TECHNOLOGY.,JSC. will strictly comply with this Agreement. EUP TECHNOLOGY.,JSC. will never resell users's content or information. In the event that EUP TECHNOLOGY.,JSC. charges a service fee, EUP TECHNOLOGY.,JSC. must notify users and users must voluntarily agree.

7. Maintenance and Upgrades
EUP TECHNOLOGY.,JSC. has the right to maintain and upgrade the system to better serve its users. The maintenance or upgrade process may disrupt the use of the service or the quality of the service may not be guaranteed during the maintenance or upgrade period.

Article 8: Responsibilities of EUP TECHNOLOGY.,JSC.

1. EUP TECHNOLOGY.,JSC. is responsible for supporting account holders in the use of Migii.net.

2. EUP TECHNOLOGY.,JSC. will receive and resolve complaints from users regarding issues arising from the use of the Migii.net social network. However, we will only support, receive and resolve complaints for accounts that are registered with complete, accurate, and truthful information.

3. EUP TECHNOLOGY.,JSC. is responsible for protecting the personal information of Migii.net account holders and will not sell or exchange this information with third parties, except in accordance with the law or with the consent of the account holder.

4. EUP TECHNOLOGY.,JSC. will publicly disclose the terms of service for the provision and use of the social network.

5. EUP TECHNOLOGY.,JSC. will take measures to protect the privacy of users' personal information and inform users of their rights, responsibilities, and risks when storing, exchanging, and sharing information online.

6. EUP TECHNOLOGY.,JSC. will ensure that users have the right to decide whether or not to allow their personal information to be disclosed to other organizations, businesses, or individuals.

7. EUP TECHNOLOGY.,JSC. will not proactively provide public information that violates the provisions of Article 5 of Decree 72/2013/NĐ-CP on the Management, Provision, and Use of Internet Services and Information on the Network.

8. EUP TECHNOLOGY.,JSC. will cooperate with competent state management agencies to remove or block information that violates the provisions of Article 5 of Decree 72/2013/NĐ-CP on the Management, Provision, and Use of Internet Services and Information on the Network when requested.

9. EUP TECHNOLOGY.,JSC. will provide personal information and private information of users related to terrorist activities, crimes, and violations of the law when requested by competent state management agencies.

10. EUP TECHNOLOGY.,JSC. will have at least 01 server system located in Vietnam to meet the requirements for inspection, examination, storage, and provision of information at the request of competent state management agencies and to resolve user complaints regarding the provision of services in accordance with the regulations of the Ministry of Information and Communication.

11. EUP TECHNOLOGY.,JSC. will register, store, and manage the personal information of individuals who establish personal electronic information pages and other information providers on the social network in accordance with the regulations of the Ministry of Information and Communication. Ensure that only those who have provided complete and accurate personal information in accordance with the regulations are allowed to establish personal electronic information pages or provide information on the social network.

12. EUP TECHNOLOGY.,JSC. will report in accordance with the regulations and be subject to inspection by competent state management agencies.

13. In the event of force majeure, Migii will be exempt from liability for data and premium packages if it has to stop providing services.

PRIVACY POLICY

Article 9. Purpose of Personal Information Collection

- To manage the posting and moderation of public information.
- To manage the user's traffic, the number of users using the service.
- To manage marketing activities and information to users such as sending the latest updates on the forum service and new features related to our products and services;
- Provide solutions and service changes to meet user needs;
- Manage, analyze, and evaluate data related to system data;
- Receive information, feedback, suggestions, and complaints from members to improve the quality of service;
- Contact members to resolve their requests;

Article 10. Scope of Personal Information Collection

1. Types of information collected.

- Contact information such as phone number, mailing address, email address, fax number;

2. Content of information collected
- Full name;
- Date of birth;
- Identity card or passport number, date of issue, place of issue;
- Phone number, email address.
In case users are under 14 years old and without a passport, the legal guardian decides to register their personal information to express their permission and be legally responsible for that registration.
Users have the right to refuse or not to provide all the required information. In that case, We cannot guarantee users quality services.
We will ask you to provide personal information when you register as a member of our website (Account). If this information is used for purposes other than the purpose of collection, we will ask for your permission before using this information.

Article 11. Method of Information Collection

Migii.net collects the personal information of members specified in Article 10 above through the website through the Member Registration Form provided publicly at the address Migii.net

Article 12. Storage Period of Collected Information

Migii.net social network will store for at least 02 (two) years information about accounts, login, logout time, IP addresses of users, and information processing logs posted. In all cases, members' personal information will be secured on Migii.net's server.

Article 13: Disclosure and Editing of Collected Information

We grant members the right to edit their publicly available information on the website. We will only delete or hide information when a member requests it or the information violates Migii.net social network regulations.
We publish the personal information collected from users on the Migii.net website and related websites to provide the best service to users and ensure the effectiveness of the service.
We may have to provide users' personal information to government agencies and agencies for security, customs, immigration, and other legal purposes within the scope of what is required or by law.

Article 15. Information Security Commitment

We use appropriate security measures to protect against unauthorized access, alteration, disclosure or destruction of data. These measures include reviewing internal data collection, storage, processing and security practices, as well as physical security measures to protect against unauthorized access to personal data storage systems.

We only allow authorized Migii.net social network employees to access personal information; those who need to know this information to operate, develop and improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination of employment and criminal prosecution, for violating these obligations.

Each member is responsible for the security of their Migii.net social network account password and agrees not to disclose or provide account security information to any other person or entity. Your account information is stored on a very secure server and is protected by a firewall.

Privacy regulations may have certain shortcomings due to technical glitches, or force majeure and Migii.net social network is not responsible for any losses caused by such errors. Always be careful and protect your personal information.

We will be required to disclose information if it is necessary to protect the property and safety of Migii.net social network or others, as well as to prevent illegal activities and violations that have a significant impact on other members. Or when law enforcement agencies require the provision of information.

The publisher will be responsible for the authenticity of the information and will be responsible for any legal disputes arising from his information.

Article 16. Policy on protecting the personal information and private information of users of social network services.

We publish the information specified in Articles 9, 10, 11, 12, 13, 14, 15 in this agreement so that users can understand the privacy policy of Migii.net social network.
To protect the personal information and private information of users of social network services, we use very secure storage software, information security software and firewall systems. Ensure that your customer information is not stolen.

DISPUTE RESOLUTION AND COMPLAINTS

Article 17. Dispute Resolution Mechanism

Any disputes arising between Migii.net social network and members or suppliers will be resolved on the basis of negotiation. If no agreement is reached as desired, either party has the right to bring the matter to court for resolution.
When disputes arise between members or between members and direct service providers, the website management board will be responsible for providing members with information about the service provider, actively supporting members or their representatives to protect their rights and legitimate interests.
In case of incidents due to Migii.net's fault, we will immediately take the necessary measures to ensure the rights of users.

Article 18. Dispute Resolution Procedure

Step 1: Social network members file complaints about the service or notify disputes between the parties via email: [email protected]

Step 2: The member rights protection department of Migii.net social network will receive complaints from members. Depending on the nature and severity of the complaint, Migii.net will have specific measures to support members to resolve the dispute.

Step 3: In cases beyond the capacity and authority of Migii.net, the board of directors will request members to bring the case to the competent state agency for resolution in accordance with the law.

Dispute resolution time:

In cases within the capacity and authority of Migii.net, we commit to resolving member disputes within 5 working days.

In cases beyond the capacity and authority of Migii.net, the dispute resolution time depends on the nature of the case and the competent state agency.

Article 19. Roles and Responsibilities of the Parties in Dispute Resolution

Migii.net social network will support members by providing full information and content related to service providers on the social network.

Migii.net social network has the responsibility to receive complaints and take timely action to resolve conflicts between members and third parties.

Service providers on Migii.net social network have the responsibility to provide full information related to the transaction process and have the obligation to compensate according to the agreement with Migii.net social network members if the fault lies with the service provider.

Any act of fraud or conflict on Migii.net social network will be condemned and must be held accountable before the law.

If the conflict arising cannot be resolved through agreement, it will be referred to the competent state agency for intervention to ensure the legitimate interests of the parties. At the same time, Migii.net social network has the responsibility to support law enforcement agencies by providing information about the parties during the investigation process.

Article 20. Amendments to the Agreement

The terms and conditions set forth in the Migii.net Terms of Service Agreement as published on the website may be updated or modified at any time without prior notice to users. Migii.net will clearly publish any such changes or additions on the Website, and users are obliged to update regularly.

Article 21. Conflict of Laws

In the event that one or more provisions of this Terms of Service Agreement conflict with the provisions of the law and are declared invalid by a court, such provision shall be amended to comply with the applicable law, and the remaining provisions of the Terms of Service Agreement shall remain in full force and effect.

Article 22. Warnings

1. Migii.net social network warns all users of the risks that may arise when storing, exchanging and sharing information on the network. Customer information may be attacked and impersonated by hackers. To ensure the safety of members, you should not post sensitive personal images, personal secrets, business secrets, bank account information, etc.

You own all content and information that you post on Migii.net and you can control the sharing of that information through your personal information and personal information updates. In addition: For copyrighted content such as photos, audio and video (IP content), you grant us your copyright by default: you grant us a non-exclusive, transferable, sublicensable, free, worldwide license to use any IP content that you post on or in connection with Migii.net. And it ends when you delete your IP content or your account unless your content is shared with others and those people have not deleted that content.

When you delete IP content, it is similar to emptying the trash on your computer. However, you understand that deleted content may still be in backups for a reasonable period of time (but will not be available to others).

When you make content or information public by filling in personal information or updating personal information, you are allowing everyone, including Migii.net members, to access and use that information.

We always welcome your feedback or other suggestions about Migii.net, but you understand that we may use such feedback and suggestions without any obligation to compensate you (just as you are not obliged to provide such feedback and suggestions).

2. Safety
We try our best to ensure safety on Migii.net, but we cannot guarantee it. We need your help to make Migii.net safe, with the following guarantee from you:
* You will not violate regulations such as spamming on Migii.net.
* You will not engage in illegal marketing activities such as deceptive advertising on Migii.net.
* You will not upload viruses or other malicious code.
* You will not hack login information or other users' accounts.
* You will not threaten or harass any user.
* You will not post content: with hostile language, threats, or pornography; inciting violence or containing nudity or gratuitous violence.
* You will not use Migii.net for anything illegal, harmful, or discriminatory.
* You will not do anything that could disable, overload, or impair the functioning of Migii.net's systems.

3. Registration and Account Security
Users of Migii.net must provide complete mandatory information when registering an account. Here are some commitments from you regarding registration and maintaining the security of your account:
* You will not provide any false personal information on Migii.net or create an account for anyone other than yourself without permission.
* You will not create more than one personal account.
* If we disable your account, you will not create another one without our permission.
* You will not use Migii.net if you have been convicted of a sexual offense.
* You will maintain accurate and up-to-date contact information.
* You will not share your password, let anyone access your account, or do anything that might jeopardize the security of your account.
* You will not transfer your account (including any pages) to anyone without our prior written permission.
* If you select a username or similar identifier for your account or page, we reserve the right to remove or reclaim it if we believe it is appropriate (such as when a trademark owner complains about a username that does not closely relate to a user's real name).

Article 23. Updates to the Privacy Policy

Migii.net social network will revise this Privacy Policy at any time as necessary. The updated Privacy Policy will be published on the Migii.net website and will be dated so that users can identify the latest version.

Article 25: The agreement to provide and use the Migii.net social network is valid from January 6, 2018.

Article 26: Migii only stands in the position of an e-commerce platform providing information from units that have been verified by Migii for their reputation in the industry. Users are responsible for all transactions between users and businesses providing study abroad and labor export services.
